Online Coaching Subscription – Terms & Conditions

These Terms & Conditions apply to Online Coaching services supplied by D HANSFORD PERSONAL TRAINING PTY LTD.

By purchasing an Online Coaching subscription, you confirm that you have read, understood and agreed to these Terms & Conditions.

Subscription Summary

  • Minimum Commitment: 12 weeks unless otherwise agreed in writing.
  • Billing: Recurring weekly payments at the amount displayed and accepted at checkout.
  • Automatic Renewal: After the initial 12-week minimum term, the subscription continues week-to-week automatically.
  • Cancellation Notice: A minimum of 14 days' notice is required to cancel.
  • Initial Term Cancellation: Cancellation cannot take effect before completion of the initial 12-week minimum commitment unless otherwise agreed or required by law.
  • Automatic Payments: The nominated payment method will continue to be charged until cancellation becomes effective.

1. Online Coaching Service

Your Online Coaching service may include, depending on the package purchased:

  • Individualised strength and conditioning programming
  • Periodisation and progression of training
  • Exercise selection and modification
  • Training load and fatigue management
  • Review of training performance
  • Exercise video review and technical feedback
  • Regular client check-ins
  • Nutrition and lifestyle guidance
  • Communication through the nominated coaching platform, email or agreed communication channel

The specific inclusions of your coaching package are those displayed on the relevant sales page, checkout page or written offer provided before purchase.

2. Subscription and Automatic Billing

Online Coaching is provided as a recurring subscription.

Unless otherwise agreed in writing, subscriptions are billed weekly at the price displayed and accepted at checkout.

Your first payment will ordinarily be charged when your subscription begins.

  • You authorise D HANSFORD PERSONAL TRAINING PTY LTD and its nominated payment processor to store your nominated payment method where required.
  • You authorise recurring charges to that payment method at the billing frequency shown at checkout.
  • You understand that payments will be collected automatically.
  • You understand that your subscription does not automatically terminate at the end of the initial minimum term.
  • You understand that recurring payments will continue until your subscription is cancelled in accordance with these Terms.

3. Minimum 12-Week Commitment

Unless otherwise expressly agreed in writing before purchase, Online Coaching has an initial minimum term of 12 weeks.

By subscribing, you agree to maintain and pay for the Online Coaching subscription for the initial 12-week minimum term.

The minimum term begins on the date your subscription commences.

The 12-week minimum term does not prevent you from submitting a cancellation notice earlier. However, cancellation will not take effect before your minimum commitment has been completed, unless otherwise agreed or required by law.

Nothing in this section limits any rights or remedies available under the Australian Consumer Law.

4. Continuing Subscription After 12 Weeks

At the conclusion of the initial 12-week minimum term, your subscription will continue on a week-to-week basis.

It does not automatically terminate at Week 12.

Weekly recurring payments will continue using your nominated payment method until the subscription is cancelled in accordance with these Terms.

There is no additional fixed minimum term after completion of the initial 12-week commitment unless you expressly agree to one.

5. Cancellation and 14 Days' Notice

You may cancel your Online Coaching subscription by providing a minimum of 14 days' notice.

Your cancellation notice is considered received when the cancellation request is successfully submitted or received by D HANSFORD PERSONAL TRAINING PTY LTD.

Cancellation methods:

  • Use any subscription cancellation facility provided to you.
  • Email info@coachdalehansford.com.au.

Cancellation during the initial term:

  • You may provide notice during your initial 12-week minimum term.
  • The effective cancellation date will be the later of the completion of your initial 12-week minimum term or 14 days after your cancellation notice is received.
  • If you provide notice sufficiently early for the 14-day notice period to expire at the end of Week 12, your subscription can finish at the completion of your initial commitment.

Cancellation after the initial term:

  • After completion of your initial 12-week minimum term, you may cancel at any time by providing 14 days' notice.
  • Normal subscription charges will continue during the 14-day notice period.
  • Coaching services will continue during the paid notice period unless otherwise agreed.
  • Once cancellation becomes effective, recurring billing will cease and access to ongoing coaching services may end.
  • There is no separate cancellation fee. However, amounts properly payable under the minimum commitment and 14-day notice period remain payable.

Nothing in this section limits rights available under the Australian Consumer Law.

6. Subscription Price

Your subscription price is the amount displayed and accepted by you at checkout or otherwise agreed in writing before commencement.

All prices are expressed in Australian dollars unless otherwise stated.

Any proposed change to your existing subscription price will be communicated before the new price takes effect.

Where a price change affects your ongoing subscription after the initial minimum term, you may elect to cancel in accordance with these Terms.

7. Refunds

Payments are not generally refundable merely because:

  • You change your mind.
  • You decide not to complete your prescribed training.
  • You fail to train or provide check-in information.
  • You do not utilise the coaching service during a paid period.
  • Your schedule or personal circumstances change.
  • You choose to discontinue training during the minimum commitment.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or entitlement that cannot legally be excluded. Where applicable law entitles you to a refund, cancellation or another remedy, those rights will apply.

8. Failed or Overdue Payments

You are responsible for maintaining a valid payment method for your subscription.

  • The payment processor may attempt to collect an unsuccessful payment again.
  • You may be requested to update your payment details.
  • Coaching services may be temporarily suspended while amounts remain overdue.
  • Suspension of coaching because of an outstanding payment does not automatically cancel the subscription.

You should contact D HANSFORD PERSONAL TRAINING PTY LTD promptly if you believe a payment has been processed incorrectly.

9. Pausing or Freezing Coaching

Online Coaching is not automatically paused because of holidays, work commitments, missed training, illness, injury, travel or other personal circumstances.

If you require a temporary pause, contact info@coachdalehansford.com.au before your next billing date.

Any pause, billing adjustment or alteration to your minimum commitment must be agreed in writing.

Where a subscription is formally paused, the effect of that pause on billing and the remaining minimum term will be confirmed at that time.

10. Client Responsibilities

You agree to provide accurate information reasonably required for your coaching.

Information required:

  • Training history
  • Current training status
  • Goals
  • Injuries
  • Physical limitations
  • Relevant health conditions
  • Available equipment
  • Training performance
  • Other relevant circumstances

Your responsibilities:

  • Notify your coach of significant changes affecting your ability to train.
  • Provide check-in and training information reasonably required to manage your program.
  • Use equipment appropriately.
  • Train in a reasonably safe environment.
  • Seek clarification where you do not understand a prescription.
  • Exercise reasonable judgement regarding your physical condition.

Failure to provide relevant information may affect the ability to appropriately modify or manage your training.

11. Health and Exercise

Physical training involves inherent physical demands and carries a risk of injury.

You are responsible for informing D HANSFORD PERSONAL TRAINING PTY LTD of relevant injuries, medical conditions, symptoms, medications or other circumstances that may affect your ability to participate safely.

Medical clearance may be appropriate when:

  • Returning from significant injury or surgery.
  • You have a medical condition that may affect exercise.
  • You develop symptoms requiring assessment.
  • A healthcare professional has advised you to seek clearance.

If you experience potentially serious symptoms during training, you should stop training and obtain appropriate medical assistance. Online Coaching does not replace medical diagnosis, medical treatment, physiotherapy or other healthcare services where those services are required.

12. Nutrition, Supplementation and Lifestyle Guidance

Nutrition, supplementation, recovery and lifestyle information may be provided as part of the coaching process.

Unless expressly stated otherwise, this information is coaching guidance and does not replace individual medical, dietetic or other regulated healthcare advice where such advice is required.

You remain responsible for disclosing:

  • Medical conditions
  • Allergies
  • Medications
  • Dietary restrictions
  • Other factors that may affect the appropriateness of recommendations

13. Limitations of Online Coaching

Online coaching differs from supervised face-to-face training.

Your coach cannot continuously observe your physical condition, training environment, equipment, every repetition you perform or health or injury changes you have not communicated.

You are responsible for communicating relevant concerns and exercising reasonable judgement when undertaking your prescribed training.

14. Communication

Coaching communication will occur through the platform or communication method nominated for your service.

Reasonable efforts will be made to provide feedback and responses in accordance with the service you purchased.

Unless expressly included in your coaching package, Online Coaching does not provide continuous, immediate or 24-hour access to your coach.

15. Programming and Coaching Decisions

Training programs may be modified according to training performance, adaptation, fatigue, recovery, injury status, exercise availability, equipment, schedule, competition requirements and changes in goals.

Appropriate coaching may require changes to exercises, volume, intensity, frequency, tempo, loading parameters or other components of your program.

16. Results

No particular performance, strength, physique, body-composition or health outcome is guaranteed.

Results may be affected by:

  • Adherence
  • Training history
  • Nutrition
  • Recovery
  • Sleep
  • Stress
  • Individual physiology
  • Injury history
  • Training availability
  • Factors outside the control of the coach

Online Coaching provides professional coaching and programming rather than a guarantee of a specific outcome.

17. Intellectual Property

Training programs, educational materials, protocols, videos, templates and other proprietary coaching materials supplied by D HANSFORD PERSONAL TRAINING PTY LTD remain the intellectual property of their respective owner.

You receive a personal, non-transferable right to use those materials for your own training.

Without written permission, you must not:

  • Selling the material.
  • Reproducing it commercially.
  • Distributing it publicly.
  • Providing copies to other coaches or clients.
  • Uploading it to another commercial service or database.
  • Representing the material as your own work.

You may retain your personal training records for your own use.

18. Client Videos, Images and Information

Training videos, photographs, check-in information and other material voluntarily provided by you may be used for the purpose of delivering your coaching service.

Your image, videos, results, testimonials or personal information will not be publicly used for marketing purposes without appropriate permission.

19. Privacy

Personal information may be collected where reasonably necessary to provide Online Coaching.

This may include information relating to injuries, medical history, physical limitations and other health-related matters.

Information will be handled in accordance with applicable privacy requirements and the Coach Dale Hansford Privacy Policy.

Payment details are handled through the nominated payment processor where applicable.

20. Suspension or Termination by D HANSFORD PERSONAL TRAINING PTY LTD

D HANSFORD PERSONAL TRAINING PTY LTD may suspend or terminate coaching where there is a reasonable basis to do so.

Examples include:

  • Continued non-payment.
  • Abusive or threatening conduct.
  • Serious misuse of coaching materials.
  • Deliberate provision of materially false information.
  • Conduct creating an unreasonable safety risk.
  • Circumstances making continued delivery of coaching impracticable or inappropriate.

Where reasonably practicable, concerns will first be communicated and an opportunity provided to resolve them. Any amounts payable or refundable following termination will be determined having regard to services supplied, the circumstances of termination and applicable consumer law.

21. Changes to These Terms

These Terms may be amended from time to time.

Material changes affecting an existing client's payment obligations, minimum commitment or cancellation rights will be communicated before those changes are intended to apply.

Nothing in this section permits D HANSFORD PERSONAL TRAINING PTY LTD to impose a change where doing so would be prohibited by law.

22. Australian Consumer Law

Our services come with consumer guarantees that cannot be excluded under the Australian Consumer Law where those guarantees apply.

Nothing in these Terms is intended to exclude, restrict or modify any right, guarantee, remedy or liability that cannot lawfully be excluded.

Where these Terms are inconsistent with a right that cannot legally be excluded, the applicable law prevails.

23. Governing Law

These Terms are governed by the laws applicable in Victoria, Australia.

Subject to applicable consumer rights, the parties submit to the jurisdiction of courts and tribunals competent to hear disputes arising in Victoria.

Checkout Acceptance

I have read and agree to the Online Coaching Terms & Conditions.

Online Coaching has a minimum 12-week commitment unless otherwise agreed. Payments are automatically charged weekly. After the initial 12 weeks, coaching continues week-to-week until cancelled. A minimum of 14 days' notice is required to cancel.
